Joseph I. Rosenberg, MBA, MA, CFACross Examining The Plaintiff's Economist: How much difference can economic assumptions make to the size of a damage award, and how well can the economist defend them?

Presented by Joseph I. Rosenberg, MBA, MA, CFA

Wednesday, February 26, 2014
11:30 a.m. – 1 p.m.

New Location!Semmes, Bowen & Semmes — NEW LOCATION
25 South Charles Street, Ste 1400
Baltimore, MD 21201

There are many choices in methods and assumptions that an economist makes in calculating a damage award which can result in widely varying awards. Some of the key areas of economic choice include:

  • Discounting Losses to Present Value: Two main types of discounting methods are used: Current Market Yields vs. Historical Average Yields. Although large differences in awards can result between the two method types, large differences also can result within each method, especially from the choices made within the historical method. Pros and cons between the methods and relative magnitudes of possible awards are analyzed.
  • Future Earnings Growth Rates: Choices include: Using plaintiff’s own recent earnings history; Economist using his/her own growth assumptions (e.g., inflation + x%); Relying on authoritative US government forecasts from Congressional Budget Office or Social Security Trustees. Large differences in possible awards from choosing between the two government forecast sources are examined.
  • Work Life Expectancy (WLE): Rather than simply assume a demographically-based average WLE, economists can apply discretion. Examples include substituting a specific retirement age, or adjusting WLE based on factors such as a plaintiff’s time out of the labor force, erratic work history, or the severity of injury, which can be used to justify a shortened post-injury WLE or no return to work at all. Challenges in the latter case may entail collaboration with a Vocational Expert.
  • Loss of Household Services: Loss of household services applies not only in cases of wrongful death but also of personal injury. Discretion exists with varying results in two main ways: The basis for assigning a future loss period, i.e., Joint Life Expectancy (JLE), Healthy Life Expectancy (HLE), and Full Function Healthy Life Expectancy (FFHLE); and the value assigned to mitigating losses, which in turn will vary with assumptions about age, work status, marital status, and household composition.

Joseph I. Rosenberg, MBA, MA, CFA will quantify the rough magnitudes and relative impacts on award size due to the above economist’s choices, as well as address credibility issues involving certain of those choices. More information on Mr. Rosenberg is available on his website at www.joe-rosenberg.com.

With E-Discovery rules now in place both at the federal and state level, there is no longer any safe place to hide. The good news is that there is still a place for advocacy and common sense in this new landscape. Get past the fear and take back control. This MDC Brown Bag Seminar will focus on:

  • Pre-discovery planning that can save your client money and heartache
  • Demystifying the “bits and bytes” talk that intimidates those of us who aren’t technical
  • Taking early control of e-discovery to cut costs and avoid playing catch-up
  • Using the rules and court decisions to shape your advocacy and protect your client

Mark is a principal at Miles & Stockbridge and a frequent author and lecturer on document and data retention issues as well as e-discovery issues. He was a member of a joint bench-bar committee establishing a proposed protocol for e-discovery in the United States District Court for the District of Maryland.

Sodas will be provided.
